State Cell Phone Laws
Laws regarding talking on cell phones and driving vary by state. We tell you what you need to know for each state below.
The following states have banned talking on hand-held cell phones while driving entirely: California, Connecticut, New Jersey, New York, Utah and Washington.
In these states, individual countys can impose bans on talking on cell phones while driving: Illinois, Massachusetts, Michigan, New Mexico, Ohio and Pennsylvania.
The following states actually have laws preventing bans on talking on cell phones while driving: Florida, Kentucky, Louisiana, Mississippi, Nevada, Oklahoma, and Oregon.
In some states, the offense is primary, meaning you can be pulled over just for it: California, Connecticut, Delaware, District of Columbia, Illinois, Maine, Massachusetts, Minnesota, New Jersey, North Carolina, Rhode Island, Tennessee, and Texas. Be extra careful in these states, as you can be doing nothing wrong other than talking on a phone and get pulled over and questioned.
