Starting on July 1st, 2008 all Californians will need a hands free cell phone headset if they wish to talk on their cell phone while driving. Here are some basics of the law:
- Drivers under 18 are prohibited from talking even on hands free devices.
- Law enforcement officers can pull you over just for talking on a handheld phone
- Commercial drivers are exempted until 2011
- Out of state visitors are subject aren’t exempted from this law.

While North Carolina doesn’t have a state-wide handheld ban, school bus drivers and minors (under 18 years of age) are banned from using a cell phone at all while the vehicle is in motion. This law also prohibits any use of technology associated with a mobile telephone while driving.

The new law in California requires even drivers from other states to use hands free headsets with their mobile phones to avoid getting pulled over. Even if your home state doesn’t have the same law, it still applies to you while on the roads in California.

The new California law requiring the use of hands free headsets applies differently to drivers under 18. If you are driving in California and are under 18 years old, you CANNOT talk on a cell phone while driving, even with a hands free device. This includes cell phones, pagers, laptops or other mobile devices used to speak or text.
Statistics show that teen drivers are much more likely than than more experience drivers to be involved in crashes, and the cell phone provides yet another distraction to keep teen drivers minds off the task of driving. Those under 18 tend to text message more than most other age groups and as such are banned from doing so while driving.
No one can give you permission to use a cell phone while driving if you are under 18, even your parents. Even if your car has a built in hands free device, it is ILLEGAL for drivers under 18 to use it.
Don’t let yourself get caught while driving and talking under 18, its a good way to get yourself pulled over and in trouble you dont need. When you turn 18, make sure you pick up a hands free headset to ensure you still follow the law and avoid having your day ruined.

On July 1, 2008, two new laws dealing with hands-free phone headsets come into effect. If you live in California, drive a vehicle, and own a cell phone, these laws WILL affect you. Read on to see what you can do to avoid having this law ruin your day.
The law prohibits all drivers from using a handheld cell phone, or other wireless handset, while operating a motor vehicle. There is no grace period, and the ticket will go on your record. If an officer spots you talking on your cell phone without a hands free headset or other hands-free phone device, you can and will be pulled over.
The best thing you can do to avoid getting pulled over unneccesarily is to get a Bluetooth headset or other hands free device.
